Space Story, Terms of Service and Use Space Story Inc ("SSC") provides the services and offerings of this web-site under the following Terms of Service and Use ("Terms"). SSC is provided to you exclusively under these Terms. By using SSC or Registering to use the services offered, you are stating to Agree to the Terms. SSC reserves the right to terminate any account and associated records if SSC learns false or misleading information was provided, or other violation of the Terms 1. YOUR RESPONSIBILITIES You are responsible for obtaining and maintaining all equipment necessary for Internet Access, Use of SSC and related charges. MODIFICATION TO TERMS SSC may change the Terms from time to time. Continued use of SSC following modifications or changes to the Terms shall indicate your agreement to them 3. MODIFICATION TO SSC SSC reserves the right to modify or discontinue the entire SSC system with or without notice. SSC shall not be liable to any third party should SSC exercise its right to modify or discontinue SSC. Continued use of SSC following modifications to any part of SSC shall indicate your Agreement to them 4. PRIVACY ALL information collected by SSC is Exclusively dedicated for the Use of our Members! ACCOUNT AND SECURITY You are responsible for maintaining the confidentiality of your Username and Password, and solely responsible for all activities that occur under your Username and Password. Immediately notify SSC of any Unauthorized use of your Username and Password or any other breach of Security. SSC is not liable for any loss resulting from the inadequate safeguard of the Username and Password 6. THIRD PARTY CONTENT AND MONITORING SSC is a distributor (and sometimes publisher) of content supplied by third parties and users of SSC. Accordingly, SSC has no editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information provided by other users of SSC, are those of the respective author(s) or distributor(s) of that information and not of SSC. SSC neither endorses, nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on SSC by anyone other than authorized SSC employees while acting in their official capacities. SSC has the right, but not the obligation, to monitor, revise or remove any content on SSC to determine compliance with the Terms and any other operating rules established by SSC, to satisfy any law, regulation or authorized government request, or for other purposes 7. LINKS SSC provision of a link to any other web-site or location is for your convenience and does not signify SSC endorsement of such other site or location or its contents. SSC shall not be liable for any information, software, or Links found at any other web-site, Internet location, or Source of information, or for your Use of such information. Generally, SSC does not establish Links to other web-sites 8. TERMINATION You agree that SSC, in its sole discretion, may terminate your account and remove any information posted on SSC, for any reason, including without limitation, if SSC believes that you have violated or acted inconsistently with the letter of the Terms. You agree that SSC may terminate access to SSC without notice, deactivate or delete your account and all related information and files and bar further access to such files. Further, you agree that SSC is not liable to you or any third party for Termination of access to SSC 9. DISCLAIMER OF WARRANTIES You expressly agree that the Use of SSC is at your own risk and provided on an "AS IS" basis. SSC expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to merchantability and non-infringement. SSC makes no warranty to meet any third party requirements, or that SSC will be uninterrupted, timely, secure, or error free. SSC makes no warranty for the results obtained from the use of SSC, or the accuracy or reliability of any information obtained through SSC, or, that defects in SSC will be corrected. You agree that any material or information downloaded or otherwise obtained through the use of SSC is done at your own discretion and risk, and that you are solely responsible for any resulting damage to your computer, equipment, or loss of data. SSC makes no warranty regarding any goods or services purchased or obtained through SSC or any transactions entered into through SSC. No advice or information, whether oral or written, obtained by you from SSC shall create any warranty not expressly made herein 10. LIMITATION OF LIABILITY You understand and agree, to the extent permitted under applicable Law, in no event will SSC or its Officers, Employees, Directors, Shareholders, Parents, Subsidiaries, Affiliates, Agents or Licensors be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of revenues, profits, goodwill, use, data or other intangible losses (even if such parties were advised of, knew of, or should have known of the possibility of such damages), resulting from your account with SSC 11. EXCLUSIONS AND LIMITATIONS Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that SSC may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of SSC liability shall be the minimum permitted under such applicable law 12. INDEMNIFICATION You agree to Indemnify, defend and hold harmless SSC, its Parents, Subsidiaries, Affiliates, Officers, Directors, Partners, Employees, Consultants and Agents from and against any and all third-party claims, liabilities, damages, losses, costs, expenses, fees including reasonable attorney fees that such parties may incur as a result of (1) any information your account submits, posts or transmits through SSC, (2) your account's Use of SSC, (3) violation of the Terms, (4) violation of rights of any person or entity or (5) any virus, worm or other harmful program routine input to SSC 13. COPYRIGHT AND TRADEMARKS; RESTRICTIONS ON USE The content of SSC ("Content"), excluding NASA or affiliated photos, but including without limitation, text, software, music, video and graphics is Copyrighted or Licensed by SSC according to United States and International Copyright laws and ALL Content is Owned or Licensed by SSC. Certain Marks ("Marks") such as Names, Logo, and other Materials displayed in SSC constitute Trademark, Trade-Name, Service-Mark or Logo of SSC. Use of SSC Content or Marks is Unauthorized without prior written consent by appropriate SSC representative or Agent. Ownership of ALL Content and Marks resides exclusively with SSC. All Use of SSC Content and Marks is subject to our Copyright Approval 14. MISCELLANEOUS The Terms together with our Space Story Privacy Policy, constitute the entire, exclusive and final statement of the Agreement between you and SSC, govern the Use of SSC, and supersedes any and all prior agreements between you and SSC. The Terms between you and SSC shall be governed by the laws of the State of Texas as applied to agreements made, entered into and performed entirely in Texas by Texas residents, not withstanding your actual place of residence. All lawsuits arising out of the Terms or out of your Use of SSC shall be brought in the Federal or State courts located in Travis County, Texas and you and SSC hereby irrevocably submit to the exclusive personal jurisdiction of such courts for such purpose. The failure of SSC to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the intention of the provision, and that the other provisions of the Terms remain in full force and effect. You agree that regardless of any Statute or Law to the contrary, any claim or cause of action arising out of, or related to the Use of SSC or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred 15. SURVIVAL The Terms in sections 11 through 14 as well as any other limitations on liability explicitly set forth herein shall survive the expiration or termination of the Terms for any reason.
